Compliance: Life/Health/Annuity Rate Filing Requirements

The Patient Protection and Affordable Care Act (PPACA) requires States to provide a mechanism for the public to comment on certain health insurance premium rate increase filings, and allow parties to view summary details of health insurance premium rate increases with an annual increase of 10% or more, called "threshold rate increases."

You can access information about health insurance premium rate increases in two ways:

The Health Filing Access Interface ("HFAI") is an online tool that allows you to view PPACA-related health insurance filings submitted to the Department of Insurance since June 10, 2010. You can now easily view details of health insurance premium increases and you can comment on open rate-increase filings. On the Healthcare.gov Rate Review page, maintained by the US Centers for Medicare & Medicaid Services (CMS), you can find information about "threshold health insurance rate filings," when insurance companies propose premium rate increases of 10% or more.

Arizona is an Effective Rate Review State

The federal Department of Health and Human Services (“HHS”), Center for Consumer Information and Insurance Oversight (“CCIIO”), determined that Arizona is an Effective Rate Review (“ERR) state, based on the ERR requirements in the Affordable Care Act.  Arizona became an ERR state in the individual major medical health insurance market, effective January 1, 2013, and in the small group market, effective January 1, 2014. 

The Arizona Department of Insurance and Financial Institutions applied for and received three HHS Rate Review Grants.  Consequently, federal money pays for 100% of Arizona’s individual and small group ERR programs.  The original award for the Cycle I Rate Review Grant (Funding Opportunity Number RFA-FD-10-999) was $1,000,000; Cycle II Rate Review Grant (Funding Opportunity Number PRPPR130040-01-02) was $2,000,000; and Cycle IV Rate Review Grant (Funding Opportunity Number PRPPR140068-01-00) was $1,079,000.
