WHAT ARE PUBLIC RECORDS?

A public record is a record that is reasonably necessary or appropriate for us to keep in order to maintain an accurate knowledge of our official activities. ARS § 39–121.01(B). Before making your request, please note the following:

  • Any request for documents that are readily available on our website will result in a referral to our website.
  • Arizona law does not allow us to release most records related to financial institutions and financial enterprises, certain financial records, insurance claim files, or an individual's private information, such as their social security number, birth date, driver’s license number, or medical records. 
  • Records or parts of records that are not subject to public disclosure under Arizona law and will not be disclosed in response to a public records request.
  • Records that are subject to disclosure, but which contain information that is private or confidential, will require redaction, meaning that the non-releasable portions of the document will be removed or otherwise obscured so that it cannot be read.

IF A FEE APPLIES TO YOUR REQUEST

If you are requesting copies or lists (whether on paper or in electronic format):

  • We will identify the responsive records and send you an invoice.  You must pay the invoice before we can process your request. You can pay by check or money order.  We do not accept credit card or cash payments.
  • We will contact you when we have completed your request
  • The Department charges $0.60 per 8-1/2” x 11” page for non-certified copies for copies furnished for a non-commercial request.
  • Charges for non-certified copies furnished for a verified and specified commercial purpose are $1.50 per 8-1/2” x 11” page.
  • There is an additional charge of $3.00 per document for certified copies.
  • The Department charges for actual mailing costs.  You have the option of submitting a pre-addressed air-bill label containing your billing account number (Fed-Ex, or UPS) in lieu of paying mailing costs.

HOW TO SUBMIT A PUBLIC RECORDS REQUEST
  • Complete and sign the Public Record Request Form
  • Limit the request to ONLY those records needed. Ensure the request is specific and include such pertinent information such as:
    •  Names (producer, agency, business, financial institution, financial entity, loan officer, appraiser, etc.)
    • Licensee’s license number or insurer’s NAIC number, 
    • Provide a range of dates for the records
  • Requests that are too broad will be returned for clarification and specificity. 
  • State agencies are subject to established record retention schedules.  Some older records may not be available because they have passed the retention period.
  • Under Arizona law, we are not required to compile information in a specific format in response to a public records request. Records will only be provided in established formats. 
  • We will fulfill your request as promptly as our resources and workload allow.
