NOTICE OF THE OPPORTUNITY TO COMMENT

The Department of Insurance and Financial Institutions (“Department”) is considering updating the current Life and Health Exemption Order described in Arizona Revised Statutes (A.R.S.) §§ 20-1110(F) and 20-1691.08(F).  The current order exempts certain insurance forms and advertising from filing as otherwise required by A.R.S. §§ 20-1110(A) and (E).   The new order, when issued, would replace the current Exemption Order Docket No. 15A-005-INS.


Topic for Comment

The public is invited to provide comments on the proposed Order (attached) to assist the Director in determining whether certain life, disability, and group long term care insurance forms should be exempt from applicable filing requirements.  Instructions for submitting comments appear at the bottom of this Notice.

A notable change in the proposed Order is the elimination of the previous requirement to file an annual list of exempted forms in lieu of filing the forms with the Department.  The proposed Order reminds insurers of the importance to retaining records associated with exempt forms.  The Department is particularly interested in comments regarding any practical considerations relating to insurers’ plans to comply with record keeping requirements.  In an effort to enhance transparency of the Department’s operations, the Department invites any interested parties to submit comments prior to the issuance of the new order.     

INSTRUCTIONS:

Please clearly state and support your arguments, including providing relevant citations to laws, regulations and case law.  The Department will consider all timely submitted comments.  While all comments are appreciated, the Department cannot commit to responding to or incorporating any comments into the Order.

When submitting your comment, please reference “Department L&H Exemption Order” in the subject line if submitted by email, or in the heading of any mailed document.  The Department will not consider your comment unless the above reference is prominently displayed in the subject of your email, or on any typed documents.
