Department of Insurance and Financial Institutions Rules of Practice and Procedure before the Director Rulemaking Comment Period July 15, 2022 through August 14, 2022

The purpose of this announcement is to advise interested parties that, on July 15, 2022, the Arizona Department of Insurance and Financial Institutions published Notices of Proposed Rulemaking (the “Notices”) in the Arizona Administrative Register for three separate, but interconnected, rulemakings (28 A.A.R. 1643; 1647; and 1652; July 15, 2022). These notices can be viewed at: https://apps.azsos.gov/public_services/register/2022/28/contents.pdf

The Department is initiating these rulemakings to address the structural change made on July 1, 2020, when the former Departments of Financial Institutions and Insurance merged into one Department - the Department of Insurance and Financial Institutions. The rulemakings are intended to accomplish the following goals:

1. To eliminate the redundant Real Estate Appraisal rules pertaining to hearings (A.A.C. R4-46-301.01 through R4-46-307.01) and make Real Estate Appraisal subject to the rules that govern Rules of Practice and Procedure before the Director for the Financial Institutions Division of the Department. (28 A.A.R. 1643; July 15, 2022)

2. To update and synchronize the Rules of Practice and Procedure before the Director for the Financial Institutions Division (A.A.C. R20-4-1201 through R20-4- 1220) and the Insurance Division (A.A.C. R20-6-101 through R20-6-160) while retaining the unique procedures germane to each Division. (28 A.A.R. 1647; July 15, 2022 (Financial Institutions Division) and 28 A.A.R. 1652; July 15, 2022 (Insurance Division).

The three rulemakings are designed to occur simultaneously and to have the same effective date.

The publication of the Notices also began a comment period which will be open until August 14, 2022 at 11:59 p.m. (M.S.T.). Parties who wish to submit a comment can send an e-mail to: [email protected]

For comments on the Insurance Division rulemaking (A.A.C. R20-6-101 through R20-6- 160), please use “Insurance Division Hearing Rules” in the subject line of the e-mail. General comments on all three rulemakings can use “DIFI Hearing Rules” in the subject line of the e-mail.

Parties who wish to request an Oral Proceeding on any or all of the rulemakings, should send the request in the same manner as submitting a Public Comment. If an Oral Proceeding is requested, the Department will schedule it at least 30 days after the request date. A request for an Oral Proceeding will extend the comment period to the date of the Oral Proceeding.
